2 on trial in 2011 stabbing death outside Pa. home

PITTSBURGH (AP) — A western Pennsylvania judge has refused to dismiss charges in the nonjury trial of a father and son accused in a stabbing death outside their home.

Forty-five-year-old Bryan Osborne and 21-year-old Alex Osborne of Pittsburgh are charged with criminal homicide and conspiracy in the September 2011 death of 26-year-old Michael Weismantle.

The Pittsburgh Post-Gazette (http://bit.ly/Y0qvYc ) says the older man’s attorney asked an Allegheny County judge on Monday to dismiss the charges against his client.

Attorney Patrick Thomassey said the man was defending himself and his family when a group of people showed up outside his home to confront his 15-year-old daughter. He said Weismantle retried a bottle to wield as a weapon.

The judge denied the motion, saying he needed to hear testimony about the facts in the case.
