Ohio high court to revisit woman’s death sentence

COLUMBUS, Ohio (AP) — The Ohio Supreme Court is preparing to hear arguments in the case of the only woman facing execution in Ohio.

Attorneys for Donna Roberts, of Trumbull County, plan to argue Tuesday that a trial court erred before re-imposing the death penalty on Roberts in 2007 by failing to admit evidence of Roberts’ diagnosed mental illness and brain trauma.

Roberts was sentenced to die in 2003 for killing her ex-husband after a slaying plot with her boyfriend. The Ohio Supreme Court overturned the sentence in 2006 and sent her case back to trial court for re-sentencing.

A judge and prosecutor were reprimanded by the Supreme Court in 2009 for teaming up to write her death penalty sentencing order.

Roberts is incarcerated at the Ohio Reformatory for Women in Marysville.
