Pa. teacher wants foreign jury in fondling case

ERIE, Pa. (AP) — A suspended northwestern Pennsylvania high school teacher awaiting trial on child molestation charges wants an out-of-county jury to hear his case now that new charges involving another boy have been filed last month.

The Erie Times-News ( ) reports Wednesday that the attorney for 43-year-old David Montgomery is concerned that publicity surrounding the new allegations that he molested a now-18-year-old man 10 years ago could taint potential jurors to be picked on Monday.

Those jurors are to hear charges filed in 2011 that Montgomery molested a 12-year-old boy while babysitting the previous December.

An Erie County judge did not immediately rule on the request that the trial be moved out of county or that an out-of-county jury be bused in for the trial.

Montgomery is suspended from Northwest Pennsylvania Collegiate Academy.
