NEW YORK (AP) — Lawyers for a New York City-based reporter who’s being asked to name her sources in a story on the Colorado theater shooting are asking an appellate court to quash a subpoena that requires her to testify.
The lawyers for Fox News reporter Jana Winter are scheduled to make their arguments Wednesday afternoon in New York state’s Appellate Division.
Attorneys for theater shooting suspect James Holmes are trying to learn the identity of her confidential sources whom she cited in a 2012 article that said Holmes had sent violent drawings to a psychiatrist before the attack at a movie theater in Aurora, Colo., in July. They say whoever gave her the information violated a gag order in the case.
Winter’s attorneys say New York’s shield laws protect journalists’ sources.
