Ind. doctor denied bond in 4 Neb. slayings

OMAHA, Neb. (AP) — A Nebraska judge denied bond Tuesday to an Indiana doctor accused of killing four people with ties to an Omaha medical school that kicked him out of a residency program more than a decade ago.

Dr. Anthony Garcia, of Terre Haute, Ind., is accused of fatally shooting Creighton University pathologist Roger Brumback and fatally stabbing Brumback’s wife, Mary, earlier this year at the couple’s home. Garcia also is accused in the 2008 killings of 11-year-old Thomas Hunter, whose father worked at the university, and his family’s housekeeper, Shirlee Sherman.

Garcia was arrested in Illinois last week and extradited Thursday to a jail in Omaha. On Tuesday, Judge Lawrence Barrett ruled that Garcia would have to remain in jail ahead of his trial.

Roger Brumback was chairman of the Creighton University School of Medicine’s pathology department, while Hunter’s father was a professor who worked closely with Brumback in the department. The two men had fired Garcia from the pathology residence program for “unprofessional conduct” in 2001.

Attorneys for Garcia, who was wearing a yellow jumpsuit during his appearance in Douglas County Court, argued unsuccessfully that there wasn’t enough evidence to try Garcia. He is due back in court for a preliminary hearing on Aug. 14, when the judge will decide whether there’s enough evidence for a trial.

Nebraska prosecutors are weighing whether to seek the death penalty against Garcia. Regardless, a conviction of first-degree murder in Nebraska brings a minimum sentence of life in prison without parole.
