YOUNGSTOWN, Ohio (WKBN) — A Weston Street couple was indicted Thursday by a Mahoning County grand jury in connection to the abuse of a 9-year-old boy on New Year’s Eve.
Tommy Murphy, 36, was indicted on one count of felonious assault and three felony counts of endangering children. Amber Murphy, 28, was indicted on two felony counts of endangering children.
The indictment states that both have been previously convicted of child endangering. Amber Murphy is the mother of the victim and Tommy Murphy is her husband and the victim’s stepfather, according to a Youngstown police report filed Jan. 2.
The report states police were called to Akron Children’s Hospital Mahoning Valley by a social worker from Mahoning County Children’s Services. The social worker said the child, a 9-year-old boy, came to the hospital around 4:30 p.m. Jan. 1 with his mother and siblings.
The social worker said the boy had visible injuries to his neck and Amber Murphy told the social worker that her husband, Tommy Murphy, had assaulted her son around 10:45 p.m. on Dec. 31, the police report states.
The boy told police he and his brothers were upstairs when his stepfather came up, slammed him to the floor, choked him, kicked him in the upper right leg and then stepped on his neck with his boots on. He told police his brothers witnessed the assault, and his stepfather was upset with him because he was eating his mother’s chocolate candy, the report states.
Amber Murphy told police she did not see the assault, but her son came to her on New Year’s Day and showed her his injuries. She said she took him to the hospital because his neck was swollen and he was having trouble swallowing food.
Amber Murphy told police she already had spoken with Children’s Services and was told not to take the children back to the house or anywhere near Tommy. She said she planned to stay at a relative’s house in Campbell once her son was released.
The report states Amber Murphy told investigators her husband has a drinking problem and he was drunk when he assaulted her son. She also said Tommy Murphy has been arrested in the past for domestic violence when he assaulted her.
According to Mahoning County Jail records, the couple has not yet been arrested on the charges.
