Yo. man gets 8 years in child’s death

YOUNGSTOWN, Ohio (WKBN) – A Youngstown man will spend the next eight years behind bars for the death of his 4-month-old daughter.

Evan Lee, 23, was found guilty last week of involuntary manslaughter and child endangering following a bench trial by Mahoning County Common Pleas Judge John Durkin. An autopsy showed 4-month old Ila Lee died of a head injury in May of 2013.

Lee told police his daughter was choking on water, so he shook her.

Before sentencing, Lee’s wife and mother-in-law begged Durkin for leniency.

“Even a person with medical knowledge might not do what they are taught if it’s their child when they are panicking. You just don’t know what you’re going to do and all he tried to do was a save Ila and I thank him for that,” Tamika Haywood, the victim’s maternal grandmother, said.

“You can give him anything, just not 11 years in prison, he don’t deserve it. I mean, he don’t. He don’t deserve it at all,” Thomasina Haywood, the victim’s mother, said.

The prosecutor had recommended the maximum sentence of 11 years, but Judge Durkin noted that Lee had no prior criminal record.
