WARREN, Ohio (WKBN) – During a special meeting this morning, Trumbull County commissioners ended a contract on the Vienna Project and the Kinsman Project.
Both projects were contracted with Marucci & Gaffney. Commissioner Frank Fuda says the projects are well beyond deadlines.
“There are problems in both projects. The contracter doesn’t seem to be moving in the direction to fix those problems, so we have no other choice,” Fuda said. “We’ve given them every chance possible.”
Within minutes after that meeting, attorney Joe Cavasinni walked across the street to the Clerk of Courts to file a lawsuit for 1.3 million dollars in damages for the Vienna Project.
“The county’s focus on day one was to get both of these projects completed and get the work done correctly. It’s unfortunate that we find ourselves in litigation,” Trumbull County Commissioners Attorney Joe Cavasinni said.
The lawsuit claims Marucci & Gaffney violated the contract by refusing to do work given by the county’s engineer.
WKBN contacted Marucci & Gaffney both on the phone and in person, with representatives declining to give comment.
Commissioners said they could lose some grant money if the project is not finished on time.
