CLEVELAND (AP) – The family of a 12-year-old boy fatally shot by police as he was carrying a pellet gun is again asking a prosecutor to publicly say if he plans to request that grand jurors charge officers in the death.

Attorneys for Tamir Rice’s family in a letter Monday renewed the family’s calls for Cuyahoga County Prosecutor Timothy J. McGinty to publicize his recommendation before telling the grand jury.

The letter says the prosecutor should disclose his plans to the public and the family if he intends to be “transparent.”

Messages seeking comment were left Tuesday for the prosecutor. His office is presenting evidence in the November 2014 shooting to a grand jury.

Jurors will decide if the officer who shot the boy or his training officer should be charged criminally.
