DAYTON, Ohio (WDTN) – Police were called to a Dayton McDonald’s for an alleged drunk driver in the drive-thru.

Officers responded to the restaurant on North Gettysburg Avenue on Friday after 11:30 p.m.

When officials arrived, they found a car in the drive-thru with the driver sleeping in the vehicle.

Police say the vehicle was still in drive, so they tapped on the window, woke up the driver and instructed him to put the vehicle in park. Police ordered the driver out of the vehicle.

When officers asked the driver if he had anything on him that they should know about, he indicated he had a loaded gun in his waistband, which police recovered.

Police ran his vehicle registration and discovered it was on the tow list.

Officers found a cup with what they say smelled like alcohol in the car. They also recovered bullets from the center console and found a small amount of marijuana in a fishing tackle box.

Police conducted a field sobriety test on the driver. They say he failed the test, but agreed to take a breathalyzer test. Police report the driver blew a 0.164.

The driver was issued a misdemeanor for marijuana and a citation for OVI. He faces charges of using weapons while intoxicated, and OVI.
