FOLEY, AL (WKRG) – It’s currently not a crime to refuse a breathalyzer in Alabama, but that could change.
On Thursday, the U.S. Supreme Court ruled police must obtain a search warrant before forcing drivers to take blood alcohol tests. Search warrants are not needed for breath tests, which are considered less invasive.
The high court’s ruling opens the door for individual states to make refusing to take a breathalyzer illegal.
All 50 states automatically revoke licenses when drivers refuse to take breath tests, but it’s only a crime in 11 states.
